Thank you for considering Smoky Escape Cabins! Cabin rental terms and conditions below apply to all rentals.

HOUSE RULES & POLICIES

To ensure the safety, comfort, and enjoyment of all our guests, we have these policies in place. By booking with us, you agree to comply with these rules and policies:

BOOKING & GUEST REQUIREMENTS

  • Booking/primary guest must be 25+ years old (required by HOA and insurance compliance).

  • Booking guest must be present for the entire stay.

  • Only registered guests are allowed on the property; no unregistered visitors.

OCCUPANCY & REGISTERED GUESTS

  • Maximum occupancy is 10 guests total, including children of all ages and visiting guests.

  • Exceeding the maximum occupancy may lead to immediate cancellation without refund and a $250 fee to cover extra cleaning, utilities, and enforcement.

  • We are not liable for any injuries or damages caused by guests, whether registered or unauthorized.

ID VERIFICATION & RENTAL AGREEMENT

These steps are mandatory to finalize your reservation and ensure compliance with our property policies, HOA, and insurance requirements.

  • Primary guest must provide a copy of their government-issued photo ID (e.g., driver’s license) within 48 hours of booking.

  • Electronically sign a rental agreement within 48 hours.

Privacy: All verification details are used exclusively for booking compliance, verification, and documentation purposes, and are handled in accordance with Airbnb’s policies and our legal obligations.

NO PETS / ESA POLICY

We maintain a strict animal-free environment due to severe allergies affecting family members and guests. For this reason, pets and emotional support animals (ESAs) are not permitted on the property under any circumstances, in accordance with Tennessee State Law SB 1595 (effective March 2024).

SERVICE ANIMALS (ADA-COMPLIANT)

In compliance with the Americans with Disabilities Act (ADA) and Airbnb’s policy, legitimate service animals trained to perform specific tasks for a person with a disability are welcome.

To help us prepare for your stay and remain compliant, we may ask the two ADA-approved questions:

  1. Is the animal required because of a disability?

  2. What work or task has the animal been trained to perform?

(Please provide this information at the time of booking.)

SERVICE ANIMAL RULES & GUEST RESPONSIBILITIES

To preserve the property and guest safety, handlers must follow these guidelines:

  • Animals must be leashed, harnessed, or tethered unless it interferes with their work, in which case they must be under effective voice or signal control.

  • Do not leave animals unattended at the property (even if crated).

  • Animals must be housebroken — indoor potty pads are not allowed.

  • Service animals must remain off all furniture unless medically required.

  • Waste must be cleaned up immediately and disposed of in the outdoor, bear-proof trash cans.

  • Proof of current rabies vaccination valid during your stay is required.

  • Guests are financially responsible for any damage or extra cleaning caused by the animal.

MISREPRESENTATION WARNING

Knowingly misrepresenting a pet or ESA as a service animal is a violation of Airbnb’s policy and federal and Tennessee law. If misrepresentation is discovered:

  • Any violation will be reported to Airbnb and will result in cancellation of the reservation without refund.

  • A $500 fee will be charged to cover deep cleaning, sanitation, and policy enforcement.

  • The incident will also be reported to local authorities in accordance with Tennessee law.

NO WEAPONS OR FIREARMS

The use or possession of firearms, air rifles, BB guns, bows, arrows, or any other weapons is strictly prohibited on the property and surrounding area. This includes both indoor and outdoor spaces.

NO PARTIES OR EVENTS

Parties and events are strictly prohibited per Airbnb policy and local laws. Violations will be reported and may result in cancellation without refund. If a party is confirmed, the following charges will apply: $260–$500 cleaning fee, depending on actual cleaning costs.

NO SMOKING

  • Smoking is strictly prohibited inside the cabin.

  • A $500 cleaning fee will be charged if there is any evidence of indoor smoking. This covers professional deodorization and ozone machine rental.

NO FIREPITS OR OPEN FLAMES

For safety and to comply with HOA and fire regulations:

  • Firepits, campfires, or open flames are strictly prohibited anywhere on the property.

  • This includes portable firepits, chimineas, or DIY fire setups.

NO FIREWORKS ALLOWED

Fireworks are illegal within the City of Gatlinburg and banned by local ordinance.

  • No fireworks of any kind are permitted — this includes sparklers, roman candles, all types of pyrotechnics, and novelty explosives.

  • The region is at high risk for wildfires, especially during dry months.

FIREPLACE USE

The indoor fireplace is available for use from October through April only.

FIRE SAFETY

Fire extinguishers and smoke detectors are located throughout the cabin and are inspected annually by the Fire Marshal. Tampering with, disabling, or removing any fire safety device is strictly prohibited. A $250 fee will be charged to cover replacement and professional re-inspection if applicable.

NO ILLEGAL DRUGS

The use, possession, or distribution of illegal or illicit substances is strictly prohibited on the property to ensure the safety and comfort of all guests.

NO SUBLEASING OR PAID EVENTS

Subleasing the property, hosting paid events, or holding gatherings that are not included in the original reservation is strictly prohibited.

NO CRIMINAL ACTIVITY

The use of the property for any illegal activity is strictly prohibited and will result in immediate cancellation of the reservation without refund.

NO FEEDING BEARS

Feeding black bears is illegal and extremely dangerous. Bears are active in the area — do not leave food or trash outside unattended. Always lock your car doors, cabin doors, and windows to prevent bears from entering. This rule is in place to protect both our guests and the bears.

OWNER’S CLOSETS

Closets marked as “Owner’s Closet” are for the owner’s private use only. Please do not open or tamper with them during your stay.

EV CHARGING NOT ALLOWED

For safety and electrical capacity reasons, EV charging is not permitted on the property. Please use nearby public charging stations.

BY RENTING THIS PROPERTY, YOU AGREE TO THE FOLLOWING:

  1. You confirm that you have a primary and permanent residence elsewhere.

  2. You affirm that the purpose of your stay is strictly for short-term, transient use only.

  3. You acknowledge and agree that this reservation does not establish a landlord-tenant relationship — it is a temporary guest agreement with the property owner.

LIABILITY DISCLAIMER

The owner is not liable for any special, incidental, or consequential damages, including those related to the use of the hot tub, bunk beds, or any other feature of the property. Guests use all amenities at their own risk.
